Company and formation

Start a Delaware company formation

What the formation intake asks for, what payment covers, and what comes after.

Updated 2026-10-11

Institution prepares, files, and delivers Delaware entities. Formation is Delaware only. Start it from Company, then Formation.

Steps

  1. Choose Start Delaware formation. Your draft is saved as soon as it is created, so you can stop and pick up later.
  2. Complete the intake: the company and applicant information, the formation package, members or directors and officers, shares and shareholders where they apply, and your accounting year-end.
  3. Review your answers and confirm the acknowledgements, including that you are authorized to submit the request.
  4. Continue to secure checkout to pay the service fee and state filing fees.

What payment does and does not mean

Important

Payment does not mean the company has been filed or approved by Delaware. It starts the work. Institution prepares the formation documents and sends them to you for review and electronic signature.

After checkout

Formation shows the latest recorded filing and document status. If you asked for EIN coordination, it appears there too. Documents you need to sign are on the Signatures page, and the Action Center flags formation information when it is waiting on you.

Note

If you do not finish, your draft stays in Formation. You can continue it or delete it. Deleting a draft cannot be undone.
