Keep a Canadian section 156 election tied to the right group transactions

Maintain the member, effective-date and transaction records behind a Canadian GST/HST election to treat qualifying intercompany supplies as made for nil consideration.

Locate the election before changing intercompany tax codes

A Canadian group should be able to show which entities have a valid section 156 election with each other and when it applies. Retrieve the filed RC4616, any appended member list, effective dates and later revocations. An ownership diagram or an intercompany policy is useful background, but neither documents that the election was actually made.

CRA describes a joint election between specified members of a qualifying group to treat certain taxable supplies as having nil consideration for GST/HST. The eligibility tests involve more than management's description of companies as related. Ask the group's tax adviser to confirm the qualifying members and preserve that conclusion with its ownership evidence.

Build a dated register of covered entity pairs

List the supplier, recipient, reviewed eligibility period, election effective date and any end date. Where a form contains several members, preserve the submitted list and its version. Use stable entity identifiers internally so a later name change does not create an apparent new member or hide a departed one.

For illustration, a group might acquire a subsidiary midway through the year while an older election remains on file for two existing companies. The acquisition record tells finance when ownership changed; it does not establish that the newcomer was covered by the earlier document. Put the new member's transactions into a specific review queue until the election position is confirmed.

Compare that register with supplier and customer tax settings in each entity's ledger. If both sides use separate systems, check both mappings. A tax code copied across the whole vendor master can extend treatment to a company or period outside the approved register.

Review the supply even when the members qualify

CRA identifies exclusions, including sales of real property and supplies that the recipient does not acquire exclusively for commercial activities. A valid election therefore needs a transaction-level scope check. Keep property transfers and unusual noncommercial use visible instead of routing every group charge through the recurring service code.

Record the description, date, amount, supplier and recipient for each reviewed charge. Link the agreement and the evidence of recipient use where that fact determines scope. Ask the adviser to resolve unusual reorganizations or mixed-use supplies, and save the decision with the affected transactions.

The election's GST/HST treatment does not establish the commercial amount of a management charge. Keep the ordinary service calculation and bilateral balance reconciliation available. A transaction can need no GST/HST under the election while still requiring an accurate expense and receivable in the respective books.

Recheck membership when the group changes

Add an election review to the closing checklist for acquisitions, disposals, reorganizations and registration changes. Give the tax adviser the legal completion date and the first affected supplies. Record any filing or revocation instruction with an owner and evidence of completion.

At period end, compare the transactions using the election code with the approved pair-and-date register. Investigate supplies before coverage began, after coverage ended or between unlisted entities. Preserve the correction schedule and assess both parties' returns where required. The retained file should explain why each exception was accepted or corrected, rather than leaving a zero-tax code as its only explanation.
