Build a factual chronology for a tax-penalty relief review

Connect the missed obligation to dated evidence and subsequent corrective actions so a qualified adviser can assess a reasonable-cause request.

Identify the penalty and the obligation it concerns

Start with the notice, tax form, period, penalty type and relevant deadline. Filing late, paying late, making a late deposit and filing an inaccurate information return are different failures. The IRS says reasonable-cause standards depend on the penalty and do not apply to certain penalties, including estimated-tax penalties.

Ask the qualified adviser which relief route is appropriate before drafting a narrative. The purpose of the company packet is to establish accurate facts and evidence. It should not assume that a sympathetic event qualifies for every kind of relief or that a general letter will address all assessed charges.

Track the notice response or appeal dates independently. Preparing evidence should not obscure an approaching deadline. Assign an owner for the current obligation as well, because a relief request does not itself file a missing return or make an unpaid deposit.

Connect the event to the inability to comply

Create a dated sequence showing what happened, who had authority to act, what records or systems were unavailable and how that prevented the required action. The IRS asks for the circumstances surrounding the failure and the attempts made to file, deposit or pay. Include the beginning and ending dates of the disruption.

Preserve contemporaneous messages, system error records, requests for missing documents and relevant external evidence. A later recollection can help explain a gap but should be labeled as such. Avoid describing an outage as lasting longer than the provider's incident record supports.

For a hypothetical payment failure, distinguish the original submission, rejection, discovery and successful replacement dates. The chronology should also show any available alternatives considered. A payment instruction prepared before the deadline is not the same event as a deposit accepted by the agency.

Include the facts that complicate the explanation

The IRS notes that reliance on a preparer, lack of knowledge, ordinary mistakes and lack of funds do not generally establish reasonable cause by themselves for failure to file or pay. Give the adviser the complete circumstances instead of removing facts that seem inconvenient to the requested relief.

Explain who handled other business affairs during the disruption and what backup arrangements existed. If relevant records became available before filing occurred, identify the intervening work and dates. The adviser needs to assess the full period of noncompliance, including the company's response after the original obstacle ended.

Limit sensitive supporting material to what the review requires. For illness or incapacity, agree with the adviser what documentation establishes the relevant dates and inability to act. Do not circulate a person's complete medical history through ordinary finance folders when a narrower record supports the facts.

Submit the reviewed account and retain the outcome

Organize the packet with a chronology, document index and the specific penalty under review. Let the authorized taxpayer or representative prepare and submit the request through the appropriate process. Keep the final explanation consistent with the evidence and distinguish an estimate from a documented date.

Retain delivery evidence, agency correspondence and any decision. If relief is granted in part, compare the revised account with the decision rather than assuming all interest and penalties disappeared. Ask the adviser about remaining charges and any available next step within the applicable time limits.

Document the operational change made after the failure, such as backup filing access or deposit-status monitoring. Preserve the correction evidence with the relief file. The completed packet should show what happened, how the company responded and what the agency ultimately decided, without presenting relief as guaranteed.
